1. Who you are contracting with
SparkJournal ("the Service") is operated by Atlantic Cape Concepts LLC ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.
2. Eligibility and accounts
Kid accounts are for users aged 8–17 and require a guardian email. Adult accounts are for users aged 18 or older. You must provide accurate information and keep your credentials confidential; you are responsible for activity under your account. Paid subscriptions must be purchased by an adult.
3. Acceptable use
You agree not to:
- Use the Service unlawfully or for fraud, spam, or harassment.
- Upload content that infringes intellectual property, is sexual, violent, or hateful, or that targets or endangers a minor.
- Interfere with the security of the Service — probing, scanning, scraping, uploading malware, or bypassing rate limits.
- Reverse engineer, resell, or redistribute the Service.
4. Your content
You keep ownership of the reflections, images, and boards you create. You grant us a limited, worldwide license to host, store, and display that content solely to provide the Service to you and (for kid accounts) to your verified guardian. You are responsible for the content you upload and must have the rights to any images you add.
5. AI Studio
AI Studio uses third-party models to generate images from your inputs. Outputs may be inaccurate or unexpected. You are responsible for how you use outputs and for having rights in the inputs you provide. We may block prompts or outputs that appear unsafe, and we do not permit use of the Service to generate content that depicts minors sexually, promotes self-harm, or violates applicable law. Repeat infringement will result in account termination.
6. Payments, subscriptions and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries for orders and handles returns. Prices are shown in USD unless otherwise stated; applicable sales tax or VAT may be added at checkout. Subscriptions renew automatically at the end of each billing period unless canceled beforehand.
7. License to the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service. All software, branding, and content owned by us remains our property.
8. Availability and warranties
The Service is provided "as is". We do not warrant that it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of the Service is capped at the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence.
10. Suspension and termination
We may suspend or terminate your account for material breach, non-payment, security risk, or repeated violations of these Terms. You may close your account at any time. When your account ends, your content is deleted per our Privacy Notice.
11. Indemnity
You will indemnify us against third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
12. Changes
We may update these Terms from time to time. We will post the updated version and, for material changes, notify you by email or in-app.
13. Governing law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in New Jersey, unless a different venue is required by consumer protection law where you live.
